The short version

Use FrockBot lawfully and thoughtfully. You remain responsible for what you give a bot, the integrations you enable, and decisions you make using its output.

1. Agreement and operator

These Terms of Service (“Terms”) are an agreement between you and Tim O'Connell, the operator of FrockBot (“FrockBot”, “we”, or “us”). They apply to the FrockBot hosted service, apps, and related services we provide. By using those services, you agree to these Terms and the Privacy Policy.

If you use FrockBot for an organisation, you confirm that you have authority to accept these Terms for it. You must be legally capable of entering this agreement. If you do not agree, do not use the service.

2. What FrockBot provides

FrockBot is an environment for creating and operating persistent conversational bots. Depending on the version and configuration, a bot may keep sessions and memory, run tools or routines, use installable packages, interact with an AI model, or use an optional computer.

Features may be experimental or offered as early access. We may add, remove, or change features as the service develops. Open-source code is also available separately under the licence included with that code; these Terms govern the services we operate, not a third party's independent deployment of the code.

3. Sign-in and your user

You must provide accurate sign-in information, use only a Google identity you are entitled to use, and keep access to it secure. You are responsible for activity carried out through your FrockBot user, except to the extent caused by our breach of these Terms or failure to use reasonable care. Tell us promptly if you believe access has been compromised.

4. Acceptable use

You must not use FrockBot, a bot, package, tool, or computer to:

  • break the law or infringe another person's rights;
  • harass, threaten, exploit, defraud, or impersonate anyone;
  • create, distribute, or facilitate malware or destructive code;
  • gain unauthorised access to systems, accounts, data, or networks;
  • evade safeguards, probe for vulnerabilities without permission, or disrupt the service;
  • send spam or automate abusive, deceptive, or unlawful activity;
  • upload content you do not have the right to use or disclose; or
  • help another person do any of these things.

Use human review where the consequences matter. Do not rely on a bot as the sole basis for decisions that could significantly affect a person's rights, safety, health, finances, employment, or access to essential services.

5. Your content and intellectual property

“Your Content” means prompts, files, memory, bot configuration, package content, and other material you submit to the service. As between you and FrockBot, you keep your rights in Your Content. You give us a non-exclusive, worldwide licence to host, copy, process, transmit, display, and otherwise use Your Content only as needed to operate, secure, and support the service and follow your instructions.

You confirm that you have the rights and permissions needed for Your Content and its use with FrockBot, including when a bot sends it to a model, tool, website, or optional integration. You are responsible for reviewing content before sharing sensitive or confidential material.

Subject to applicable law and third-party rights, you may use output generated for you. AI output can be inaccurate, incomplete, offensive, or similar to output produced for someone else. We do not promise that output is unique or that you will own every right in it. You must review output and decide whether it is appropriate to use.

FrockBot and its branding, site design, and service software are owned by us or our licensors. These Terms do not transfer those rights to you. Separate open-source components and installable packages remain subject to their own licences.

6. Models, packages, and optional computers

FrockBot can interact with third-party services, including Google sign-in, Cloudflare infrastructure and AI, a model endpoint you configure, websites and tools used by a bot, and an optional Fly.io Sprite computer. Their terms, charges, availability, and privacy practices may apply separately.

You decide whether to install packages or configure optional desktop integrations and credentials. You are responsible for checking their permissions and suitability. We are not responsible for a third-party service or for content, changes, or actions outside our control.

7. Availability and changes to the service

We aim to keep FrockBot useful and available, but it may be interrupted, delayed, changed, or unavailable. Bots, routines, model calls, tools, memory search, and optional computers can fail or behave unexpectedly. We do not promise uninterrupted service, preservation of every item of data, or that a feature will remain available. Keep separate copies of content you cannot afford to lose.

We may impose reasonable technical limits or suspend a feature to protect the service, users, or others, or to comply with law.

8. Consumer rights, warranties, and liability

Nothing in these Terms excludes, restricts, or modifies a guarantee, right, or remedy that cannot lawfully be excluded, including under the Australian Consumer Law. Where the law permits us to limit a remedy for a failure to comply with a non-excludable guarantee, our liability is limited to supplying the services again or paying the cost of having them supplied again, at our option.

Otherwise, FrockBot is provided “as is” and “as available”. To the extent permitted by law, we exclude implied warranties and do not warrant that output is accurate, fit for a particular purpose, or free from harmful or infringing material.

To the extent permitted by law, we are not liable for indirect, incidental, special, exemplary, or consequential loss, or for lost profits, revenue, opportunity, goodwill, or data, arising from or related to FrockBot. This limitation does not apply to liability that cannot lawfully be limited or excluded.

9. Suspension and termination

You may stop using FrockBot at any time. You can contact us about closing your FrockBot user. We may suspend or terminate access if you materially breach these Terms, create risk or harm, do not remedy a breach after notice where appropriate, or if we must do so for legal or security reasons. We may also discontinue the service; where reasonably possible, we will give notice.

Provisions that by their nature should continue—including ownership, warranty and liability limits, governing law, and accrued rights—will survive termination.

10. Changes to these Terms

We may update these Terms as FrockBot and the law change. We will post the revised Terms here and update the effective date. If a change is material, we will take reasonable steps to give additional notice. Your continued use after updated Terms take effect means you accept them; if you do not agree, you must stop using the service.

11. General

If part of these Terms is unenforceable, the rest continues to apply. A delay in enforcing a right is not a waiver. You may not transfer these Terms without our consent. We may transfer them as part of a reorganisation or transfer of the service, subject to applicable law. These Terms and the Privacy Policy form the entire agreement about the operated service unless we agree otherwise in writing.

These Terms are governed by the laws of Australia. You and FrockBot submit to the non-exclusive jurisdiction of courts with jurisdiction in Australia.
